Preamble
Fokken & Müller GmbH & Co. Musikvertriebs KG – hereinafter referred to as “LMC” or “LMC operator” or “operator” –
sells tickets for the Live Music Center Emden. The LMC operators have taken over the management of the Live Music Center Emden. This includes renting out the Live Music Center to event organizers and providing support in marketing the events. Fokken & Müller GmbH & Co. Musikvertriebs KG is the owner of the Live Music Center Emden. All parties involved want to enrich cultural and social life in the region with the event hall. Visitors should be able to experience impressive events at the Live Music Center Emden.
1. Scope of application
Unless expressly agreed otherwise in writing, all legal transactions concluded by LMC operators are governed exclusively by these General Terms and Conditions.
2. Conclusion of contract
LMC operators sell tickets solely as an advance sales agent for the respective event organizer, i.e., contractual relationships are established exclusively between the ticket holder (customer) and the respective event organizer, unless LMC operators are themselves the event organizers in individual cases. In all other respects, the general terms and conditions of the respective venue and/or organizer apply. The customer may only purchase tickets in their own name and on their own account. If the customer is a reseller and resells the tickets, they are not acting as a representative of the LMC operators.
3. Shipping and reservation
Tickets will be sent to the customer after payment has been received on time. Tickets are shipped at the risk of the purchaser. LMC operators reserve the right to choose the transport company for the tickets themselves. The LMC operators are not obliged to replace tickets lost in transit or if the customer loses their tickets. The LMC operators are only liable for damages in cases of intentional or grossly negligent behavior.
4. Terms of payment of the payment service provider MOLLI B.V.

(2) Payments are processed through our external payment service provider Mollie B.V. (hereinafter "Mollie"). Mollie is a Dutch-based and regulated company that provides payment services. 4.1 Data protection of the payment service provider
(1) Personal data is transferred to Mollie in the context of processing payments via Mollie. This data includes your name, address, email address, and payment information.
(2) Mollie processes this data in accordance with applicable data protection regulations and Mollie's privacy policy. For more information, see Mollie's privacy policy at [https://mollie.com/privacy].
(3) We do not store any complete payment information (e.g., credit card numbers). This information is processed exclusively by Mollie.
4.2 Conclusion of contract and ordering process
(1) The contract is concluded as soon as you click on the “Buy” button (or similar) during the ordering process on our website and complete the order.
(2) After completing the order process, you will receive a confirmation email with an overview of your order and further payment information.
(3) Payment will be made via Mollie using the payment method you have selected.
4.3 Right of withdrawal and refunds
(1) You have the right to cancel your order within 14 days without giving any reason.
(2) In the event of a cancellation, the purchase price including shipping costs will be refunded within 14 days of receipt of your cancellation and return of the goods via the originally selected payment method. The refund will be made via Mollie.

6. Event cancellation and liability in cases of force majeure
(1) The organizer reserves the right to cancel or postpone the event for important reasons, in particular in cases of force majeure. Force majeure includes all events beyond the organizer's control that make it impossible or unreasonable to hold the event. This includes, in particular, natural disasters, epidemics, pandemics, official orders, war, terrorist attacks, strikes, and other unforeseeable, serious events.
(2) In the event of cancellation or postponement of the event due to force majeure, the organizer is not obligated to pay damages or other compensation. However, the organizer will endeavor to offer an alternative date. If an alternative date is not possible or if the customer is unable to attend on the alternative date, the ticket price paid will be refunded.
(3) Further claims by the customer, in particular for reimbursement of travel and accommodation costs as well as for lost enjoyment or other damages, are excluded.
(4) The organizer will inform the customer as soon as possible about any cancellation or postponement of the event and will communicate the terms of the refund or alternative date.
7. Liability
(1) We shall only be liable for damages in cases of intent and gross negligence. In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations (cardinal obligations).
(2) Liability for payment transactions processed via Mollie lies with Mollie in accordance with its general terms and conditions and privacy policy.
8. Additional provisions for events at the Live Music Center Emden
The general terms and conditions of the respective organizer apply to events at the Live Music Center. In particular, the following regulations apply:
At concerts and other events, the noise level may pose a risk of hearing and health damage, for which the organizer assumes no liability.
Liability for property damage and personal injury is excluded.
Bringing bottles, glass containers, cans, pyrotechnic items such as sparklers, torches, and weapons is generally prohibited. Failure to comply will result in removal from the venue.
Bringing tape recorders, film, or video cameras is strictly prohibited. Sound, film, and video recordings – even for private use – are strictly prohibited.
If the event is postponed or canceled during the event, the ticket purchaser is not entitled to a refund of the purchase price. Tickets will only be accepted in the event of a general cancellation of the event up to two weeks after the event date at the box office where the tickets were purchased. The advance booking fee will not be refunded under any circumstances.
The ticket loses its validity upon leaving the hall.
Contractual relationships are established through the purchase of the ticket exclusively between the purchaser and holder of the ticket and the organizer.
9. Data protection and data processing
Customers' personal data will be collected, processed, and used in an automated manner in compliance with data protection law to the extent necessary for the execution of the contract. The LMC operators are entitled to pass on the data to natural or legal persons who have commissioned the LMC operators with ticket sales, in particular to the respective event organizer. As long as the customer does not object, the LMC operators are also entitled to collect, process, and use the data received for customer consultation, advertising, market research for their own purposes, and to tailor our offers to meet customer needs. This consent can be revoked at any time without giving reasons.
10. Availability of the services offered
(1) The Live Music Center endeavors to make the tickets and other services offered in this ticket shop available to customers at all times and in full. However, the Live Music Center assumes no liability for the uninterrupted usability or accessibility of the tickets and other services offered, nor for transmission delays, incorrect transmissions, or memory failures and the associated limitations of the products and other services offered on the domain https://tickes.lmc-emden.de. It is expressly pointed out that necessary maintenance work on the website may lead to a temporary interruption of the internet offering and/or individual services.
(2) The Live Music Center expressly reserves the right to discontinue the products and other services offered, in whole or in part, and/or to restrict their availability at any time and without prior notice.
11. Final provisions
When purchasing tickets via external online ticket portals, the respective terms and conditions of the providers apply.
Should individual points of these terms and conditions be or become invalid, this shall not affect the validity of the rest of the contract. The law of the Federal Republic of Germany applies exclusively. The sole place of performance for delivery, service, and payment is Emden.
If both parties to the contract are merchants, the exclusive place of jurisdiction for disputes arising directly or indirectly from the contractual relationship shall be Emden.
